Companies that plan to sell, manufacture or engage in business with Chinese partners need to protect their trademarks, patents and other brand-related intellectual property in China. Even companies that do not sell or do business in China directly may put their business at significant risk around the world if they do not develop a brand and patent protection strategy aimed at China.


Starting with the important differences between U.S. and Chinese trademark and related intellectual property law, Britt Anderson will discuss how to identify your company’s brand assets that need protection in China, how to structure your protection program and what to register, how to structure your deals with local partners to protect your brand assets, and the types of brand infringement and some of the remedies available to brand owners for enforcement of rights.


Chris Chou will discuss issues faced by foreign entities in enforcing patents and obtaining patent protection in China. With the importance of the China market, every company -- from the newest startup to established multinationals -- owe it to themselves to understand the changing law and develop a strategy for protecting these highly valuable business assets. He will also highlight recent changes in China and U.S. patent laws and their impact on emerging companies doing business globally.


Speaker Biographies

Britt Anderson, Partner, K&L Gates


Britt Anderson is an intellectual property litigator in the Palo Alto office.  Mr. Anderson represents clients primarily in federal courts and before the Trademark Trial and Appeal Board in the fields of trademark, false advertising, copyright, rights of publicity, trade secret, domain name, licensing and related business tort and licensing matters. These cases have frequently been at the forefront of Internet-related law, including trademark and copyright infringement arising from online activities, cybersquatting and domain name issues, rights of publicity, anonymously posted content, distribution of mobile content, privacy, and online advertising.

Mr. Anderson has represented clients in multiple federal district courts throughout the U.S., including all district courts in California, the Western District of Texas, the District of New Jersey, the Eastern District of Michigan, the District of Rhode Island, the District of Massachusetts, the District of Minnesota, and the Middle District of Florida.  He has also assisted numerous clients in enforcing and defending their trademark and other intellectual property rights in non-U.S. jurisdictions before trademark authorities and in foreign civil infringement and anti-counterfeiting actions.

In addition, Mr. Anderson's counseling practice involves all aspects of trademark, copyright, domain name, advertising and related commercial and intellectual property matters, including developing and implementing strategies for protection of trademarks, copyrights, publicity rights, and designs, and designing and negotiating intellectual property licenses, distribution and service agreements, assignments, work-for-hire, and joint development agreements. He has also assisted numerous clients in initiating or deepening global trademark protection programs in a multitude of non-U.S. jurisdictions.

Chien-Wei (Chris) Chou, Partner, K&L Gates


Mr. Chou is a partner in the San Francisco office practicing in the area of intellectual property litigation. He is the former Director of Intellectual Property, Legal for Taiwan Semiconductor Manufacturing Company, Ltd. In that capacity, Mr. Chou had overall management of intellectual property matters including inter alia, patents and trade secrets.

He concentrates on patent, trademark, copyright and trade secret counseling. He has experience in preparation of patent applications, patent portfolio management, patent prosecution, and patent infringement/validity analysis in the areas of electronics, microprocessor, computer software, computer system/architecture and semiconductor devices/fabrication technologies. He managed patent dispute matters in Taiwan and the U.S., and negotiated various deals including joint development projects, patent and technology license agreements, and patent acquisition transactions.

Prior to that, Mr. Chou practiced with several law firms in California in the areas of intellectual property and patent litigation. In addition, he has over 13 years’ industrial experience as an engineer and manager in the area of electronics, robotics systems, and computer hardware and software design. He is a frequent speaker on technology topics.
